Based on the Electronic Communications Act – ZEKom (Official Gazette of the Republic of Slovenia, no. 13/2007 – official consolidated text 1, no. 110/2009, no. 33/2011) and the General Act on the Transparency and the Publication of Information (Official Gazette of the Republic of Slovenia, no. 96/2004, no. 59/2008, no. 55/2010), Telekom Slovenije, d.d. (hereinafter: Telekom Slovenije), publishes the following:
TERMS AND CONDITIONS OF USING THE TELEKOM SLOVENIJE, d.d. WEBSITE
1. GENERAL

1.1. The Terms and Conditions of the Telekom Slovenije, d.d., website (hereinafter: the Terms and Conditions) determine the rights and obligations of the owner of the website and its users, the ways and conditions of using the content and functionalities at www.telekom.si, where the users are to be found.

1.2. By entering www.telekom.si, users confirm that they have read these Terms and Conditions and that they agree to them and to the binding nature of the provisions.

1.3. The Terms and Conditions apply to the entire www.telekom.si website, except individual services which have their own terms and conditions. In such cases, individual terms and conditions apply.

1.4. Telekom Slovenije will strive to ensure:

that the website operates smoothly. However, it is not liable for any interruption to the power supply or failures caused by force majeure or third party actions which could not be expected, or the consequences of which could not be avoided or eliminated,

that in case of an interruption or failure in the power supply, the website will start operating again as soon as possible,

that the data published on www.telekom.si is accurate.

1.5. Telekom Slovenije does not accept any damage or other liability for errors or omissions in the content of the website. It reserves the right to change, upgrade and update the functionalities and content on the website.
2. LIMITATION TO PERSONAL AND NON-COMMERCIAL USE

2.1. Users can only use the www.telekom.si website for personal and non-commercial purposes. It is prohibited to change, copy, distribute, lease, display, play, duplicate, publish, license, make derivatives of, transfer or sell any information, software, products or services, which are part of the www.telekom.si website, unless explicitly stated otherwise in these Terms and Conditions.
3. SECURITY AND PROTECTION OF PRIVACY

3.1. The security mechanisms integrated into the website reduce the possibility of abuse. Telekom Slovenije will try to prevent any abuses with the due diligence of an expert. However, it is not liable for damage that users might suffer as a result of abuse, unless caused by Telekom Slovenije deliberately or because of grave negligence.

3.2. Telekom Slovenije is aware that privacy and personal data protection are extremely important. When users are browsing the www.telekom.si website and are not signed in to any web service, their browsing is anonymous. Users do not have access to their personal data while browsing, however Telekom Slovenije monitors how anonymous and registered users use the website. The data on the use of the website does not enable access to users’ personal data and Telekom Slovenije only uses it with the purpose of improving the use of the website.

3.3. Access to certain services at www.telekom.si and creating of a user account require all the requested data (full name, address, postal code, city, e-mail, and password). Users must, to the best of their ability, make sure that the data is accurate and up-to-date while using the services.

3.4. Telekom Slovenije provides protection of personal data for all registered www.telekom.si users.

3.5. Telekom Slovenije undertakes to protect users' privacy in line with legislation. The protection of users’ personal data comprises organizational, technical and logistical procedures and measures for protecting personal data, preventing accidental or deliberate unauthorized destruction, change or loss of the data, and unauthorized processing of the data. All the data is stored on protected servers in protected premises.

3.6. If users wish to access the data entered in the system, they need to log in to Moj Telekom by entering the correct username and password, which allows them to access the personal data on the www.telekom.si website linked to this username and password.
4. DISCLAIMER

4.1. Users are responsible for all activities performed with their user account. They must immediately inform Telekom Slovenije of any unauthorized use or suspicion of unauthorized access.

4.2. Telekom Slovenije is not liable for any loss or damage that users might suffer due to unauthorized use of their account or password.4.3. Users undertake to use the www.telekom.si website in line with these Terms and Conditions, to protect the password and comply with the regulations and notifications published on the website.
5. UNLAWFUL OR PROHIBITED USE

5.1. Users must not try to gain unauthorized access to any services on the www.telekom.si website, the computer system, the network connected with the system, or data on any other user.
6. RIGHT TO USE FEEDBACK AND SUGGESTIONS

6.1. Telekom Slovenije encourages feedback and suggestions on services and content on the www.telekom.si website as it allows it to regularly improve the services for users. Telekom Slovenije will determine which feedback and suggestions to take into consideration.
7. COLLECTING PERSONAL DATA IN THE SINGLE LOGIN SYSTEM

7.1. When registering for the services available at the www.telekom.si website, the Moj Telekom service will require users to enter certain data, which will be stored in the individual user’s user account and profiles for using individual services. Users can monitor or change their personal data and profiles for using individual services through the Moj Telekom single login system. This user account comprises data which is obligatory to enter as well as data that is optional. The data is entered into individual profiles for using individual services.

7.2. When registering in the Moj Telekom service, the user is required to select a username. The Moj Telekom service uses the username to manage the list of all users, with which it identifies and distinguishes users.

7.3. The Moj Telekom service temporarily records the existing entries in the database with the purpose of improving the efficiency and reliability of the operation. Immediately after the user logs out of the single login system or when the session expires, this information is deleted from the database.

7.4. In line with the Personal Data Protection Act, Telekom Slovenije guarantees that it will use users’ personal data for the operation and maintenance of their account and providing services at the www.telekom.si website.
8. MANAGEMENT OF AND ACCESS TO PERSONAL DATA

8.1. Users can always add, update or change data in their user account.
9. COOKIES

9.1. Cookie is a character string that the user's web browser can permanently save on the user's computer. It stores the data and choices made on visiting individual websites. The www.telekom.si website uses cookies every time a user visits it by saving the user's unique ID, the time of the login and other necessary non-personal data in a protected cookie that is temporarily stored on the user's computer.

9.2. Cookies allow users to navigate through the www.telekom.si website without having to log in for access to every page. Users can allow or prevent installment of cookies with settings in the web browser. If users do not wish to accept cookies, they will not be able to use all the services provided by the www.telekom.si website.
10. GENERAL

10.1. These Terms and Conditions regulate the relationship between users and Telekom Slovenije regarding the services at the www.telekom.si website. They replace all previous communication between users and Telekom Slovenije and offers regarding the services on the website, be it in e-form, verbal or written.

10.2. All the content on the www.telekom.si website, except the content entered by users, is copyright of Telekom Slovenije and/or its contractual partners. All rights reserved.

10.4. Telekom Slovenije reserves the right to change the terms and conditions during their validity. Changed terms and conditions enter into force and become binding for website users a day after their publication on the www.telekom.si website.

10.5. All disputes related to the www.telekom.si website are under the jurisdiction of the Ljubljana District Court.

10.6. The Terms and Conditions are published in the usual way at Telekom Slovenije and on the www.telekom.si website.

10.7.These Terms and Conditions enter into force on 1 July 2011 for new users, and on 1 August 2011 for existing users.

10.8. On the day that these Terms and Conditions enter into force, the General Terms and Conditions of Using the Telekom Slovenije, d.d., Website of 16 May 2011 expire.
